Bethesda Sues Interplay Over Fallout MMO

Bethesda has announced that it plans to sue Interplay for trademark infringement and breach of contract over the long-rumored Fallout MMO.

The suit - the documents in question can be found on The Vault - claims that Interplay is in breach of contract requiring the company to start development of the Fallout universe MMOG in earnest by April 4th, 2009.

Interplay, of course, has disputed the claim, maintaining that it still holds the rights to develop Project V13 in coordination with Masthead Studios.

This, of course, is bad news for the foundering Interplay, who seem to be up a certain creek without a certain instrument - without funding for V13, and with legal troubles atop of that, the studio's continued existence may be in jeopardy.

On the bright side, V13 concept artist Natiq "Defonten" Aghayev has released a piece of art he did for the game, pictured here. Yes, it's gorgeous and compelling concept art for a game that may never see the light of day.

Am I really dying somewhere and this is just all an illusion brought on by massive pain?

Yeah that's an old one but it's relevant. Also I thought I heard some where that the contract they signed still gave them the right to make this MMO.

I think that Bethesda is sueing because they didn't fulfill the contract requirements or something.

I hadn't noticed to be honest - I only use the Wiki for finding out the locations of things I can't find out for myself (like the bobbleheads)

that would be one thing that would make it an MMO hell. getting all the bobble heads...

You're forgetting that Bethesda bought the franchise. They have all rights to it, and so Interplay shouldn't be making a game about it.

Actually, if I remember right, Interplay has the rights to make mulitplayer Fallout games, while Bethesda has the rights to make single player games. Since Interplay is making an MMO, not a singleplayer, as the contract agreed, then this whole law suit shouldn't be happening.

Bethesda owns the whole franchise and only licensed the MMO rights to Interplay under certain conditions that Interplay failed to meet.

I hope this kills the fallout MMO once and for all. I think the fallout series is too good to be dumbed down into an MMO. Do we really need BoS dailies to collect laser pistol drops from the nearby raider camp? Or water delivery jobs?

i just dont see an MMO having the same impact story-wise as a single player game can, nor does it sound like the proper atmosphere/quality would be present (judging from the popular MMO's ive had experience with)

I hope this kills the fallout MMO once and for all.

It won't, it will just mean that ZeniMax/Bethesda will develop it instead of Interplay.

Well, I thought it was too good to be dumbed down into Oblivion with Guns. After that, I don't really care that much.

*walks over from being mentioned* yeah? what you want? *sees the post* oh. i am not that bad, i am a bit lenient concerning fallout. all i want are GOOD weapons, not old ones like a winchester rifle, a PASSABLE story (i need motivation for me risking my neck), and actual EVIL acts, not cartoon-ish stupid evil like putting a cat hair into someone's water glass. i want full blown holy shit evil like the old days. fallout fanboys are not bad as people think, they are pretty friendly, they just don't want 5 yr old halo screamers coming into their area and screaming nonsense like a halo multiplayer match such as "fallout 1 is bad, fallout 3 CD is made from pure obsidian from a volcano! a bird is chasing me cuz i put mayonaise on my head lol! omg my head is an antelope! agh!"...then again, who really LIKES screamers?

It'll still get made, but by Bethesda instead of Interplay.

Meh. Interplay needed money in a bad way. Bethesda came up to them told them they wanted to buy the rights to Fallout. Interplay said they would, but they were working on the MMO for it at the moment. Bethesda said "Oh, that's cool. How about we just buy the rights, but you get to keep MMO rights to it as long as you've made good progress on it by a couple of years from now. If you don't, then we get the full rights." Interplay said yes.

It's been a couple years and a few months change now, and it doesn't seem any further along then it was then.

Sad to say, but this isn't any type of evil ninja lawyer legal loophole sorcery on Bethesda's part to evilly gain control of the Fallout MMO rights. They put down the ground rules in black and white when they made the agreement. Hell, Beth even gave them about an extra half a year. Interplay didn't even need to have it -done-, just have had decent progress on it. They haven't, so an agreement's an agreement. If hardcore Fallout fans want to blame someone, blame Interplay for agreeing to the deal in the first place.

After a bit of research, Interplay only has rights to the MMO, but a certain stage of development in the game had to be reached by the start of April 2009. Interplay didn't meet that requirement, and therefore has no right to the game.

On top of that, they've failed to meet other requirements as well. For example, changing the name of 'the Fallout Trilogy' mwhich implies their (false) ownership of Fallout 3.

Fallout seemed pretty MMO-able really, since it would have likely been similar to one and two and making it an MMO does not seem at all a hard thing to do.
Sure they had the right to, but Bethesda seems mean for this, and well...I dont like my favorite developer being mean.

I second that. I can't really see the Fallout universe working as an MMO...I mean putting VATS in pvp?
