4chan Member Gets Jail Time For Sending Dirty Pics To School

Note to self: emailing graphic photos of a teenager to anyone is a bad idea, but sending them to his high school is particularly unwise.

4chan's members just can't seem to stay out of the news. While stories occasionally pop up highlighting the good they can do, such as helping people who are broke afford food or helping track down that girl who drowned some puppies in a river, reports of members DOS attacks and harassment of people are pretty common. Case in point, Matthew Riskin Bean, a 20-year-old member of the community, is getting sent to prison for emailing a Philadelphia high school some dirty pictures of one of its students.

So here's what happened: a high school student (who is now 18-years-old) from the Philadelphia area (known only as "Person No. 1") joined an online chat room in 2003 or 2004. During his time with the chat room, he uploaded some graphic photos of himself, including one of his fully erect penis.

According to court documents, Bean came across the photos thanks to comments on 4chan. He then sent the images to Person No. 1's high school, claiming to be a "concerned mother" of another student. In the email, he claimed that "this sort of behavior [should not be] allowed to run rampant."

How Bean was identified isn't clear, though it's known that school officials forwarded his email on to the authorities. When he talked to FBI in an interview back in September 2009, Bean stated that he and other 4chan members tried to identify Person No. 1. This interview also revealed that participants in the 4chan discussion (though not Bean, apparently) expressed the twisted hope that the student would commit suicide.

Bean was originally facing up to five years of jail time for possession and distribution of child pornography, based on the original charges, but he accepted a plea bargain of stalking. This plea included a sentence of 45 days in a federal prison.

Donald Goldberg, who served as Bean's defense attorney, argued that the jail time could do serious harm to his client, who would likely be a target for sexual predators inside the prison. Goldberg claimed that Bean's arrest was a major wake-up call and that his client is a "shy, very vulnerable young man, who is sweet beyond belief."

I'm assuming that Person No. 1 is 18 now, and so would have been underage then. That's the only way this makes sense to me, anyway.

I wonder though, if Bean was originally facing jail time for possession and distribution of child pornography, shouldn't that mean Person No. 1 is facing charges of creation and distribution of child pornography? Or does it not go both ways?

He probably should be punished for this. It's probably not the most serious thing ever, and he certainly doesn't seem to be dangerous or anything, but a crime is a crime. That said, he gets points for being hilarious.

No, it's not. It's my opinion that if you post pictures of yourself naked on the internet there are certain risks you take, such as people who use the internet (ie. potentially every single human being) acquiring those pictures. Especially if you're underage, it's just an idiotic move. As for the 4channer, perhaps it wasn't the most kind-hearted act to send those pictures to the school, but that's 4chan. Again, there are certain risks associated with that sort of behavior.

It should go both ways, but this being the American court system we know justice will be on the side of the innocent little high schooler, not the mean scary 4channer. Even though the high schooler created child pornography and the 4channer only distributed it.

They could charge him with other stuff, like obscenity, but not CP unless the pictures were taken of the guy from before he was 18.

This makes me happy. I hate it when anon tries to ruin peoples lives... the collective assholeness is ugly, and their self serving claims of teaching people to be careful do nothing to disguise the mean spiritedness behind their actions. I can see a bunch of guys going "I hope he an heroes." Well, now one of them is having his life ruined... it sucks for him, but he wanted this other kids life to be ruined. He really can't complain.

This is ridiculous, person no.1 should be in trouble. Posting naked pictures of yourself is a sign of a troubled mind, notifying his school is a civic good deed. I'm totally lost why Bean has been arrested.

If you, for example, are taken in for committing a crime, I as a judge could offer to lower the sentence for some honesty.

High school implies before 18, since most people graduate high school at about 17...

Except it still has to be a crime that you can reasonably be committed of. A ridiculous example would be if someone is accused of shooting and murdering someone and they are charged with littering, as in the bullet. That at still, albeit ridiculously, still relates to the action that happened. You can't change the situation entirely.

Also, if the guy did provide the photos to the school administration under the pretense that it was for disciplinary reasons, though that probably wasn't his intention, how does that count as distribution? If I discover illicit photos of a minor and send them to the police, can I be convicted of distribution?

Though I guess with the info that the school immediately involved the authorities, the 4chan guy probably sent the photos to the whole school.

Still, "Person 1" should be in trouble too. If the second guy is in trouble for distributing child porn, so should the guy who originally created it and distributed it to others.

"4chan member." Right. There's no registration. Anyone can look at the site, post comments on it, or upload pictures. If all of that had taken place through Live Messenger or whatever, would he be described as a "Microsoft member"?

I bet they would have tried to send him to jail for distributing child porn if he had sent them to the FBI too. Bean guilty of child pron? Hell No. Bean Guilty of Stalking? Hardly. Bean guilty of Defamation? Probably.

Bean didn't make the pictures, presumably didn't request the pictures, and presumably only distributed the pictures to "authorities". If I had been in his shoes and wanted to teach the little punk a valuable life lesson I would have sent the pictures to his parents.

I'm confused...uploaded nudes of an 18 year old aren't CP...

And if he distributed them on a message board, like say - this one - anyone reading that site would have them cached.
